Portrait Agreement

Terms and Conditions

THE CLIENT

  1. I/we have received, read and understand the Studio’s pricing as per website here. If I’m not on a prepayment plan, I understand that 50% of my chosen Collection of photographs is due 30 days before my Photo Shoot and remaining 50% is due 7 days before my photo shoot, unless on a pre payment plan.
  2. I agree the Studio owns the Copyright in all photographs. 
  3. I give permission to the Studio to use any image of our sitting for industry competitions and as required subsequent usage and for reasonable general promotional advertising for the Studio. The usage for any other purpose is to be renegotiated between the parties and requires specific permission by us.
  4. All photographs purchased include their matching digital file to the size ordered. 
  5. Images not purchased will be deleted to free up harddrive space. Only the digital images purchased will be kept on file a period of ten years for re-orders.  The digital files remain the property of the Studio.
  6. Request to resend digital files online due to loss or damage will incur a $50 fee to retrieve the files from archives.  
  7. I understand the ordering appointment takes place at Mel Watt Photography Studio unless from interstate or outside greater Brisbane area.
  8. If you request a second Ordering Appointment to finalise your order, it will incur a $100 booking fee.
  9. I understand once production commences on my order that no changes can be made and no refunds are given.
  10. I/we agree to collect the order within thirty (30) days of notification of completion of order. Digital files are not supplied until the order is paid in full and has been collected.
  11. The Studio has no control over the environment in which the photographs are kept and that photographs, in common with all sensitised material and colour dyes, have limited life expectancy which is minimised when exposed to strong and prolonged sunlight, heat or fluorescent light sources. Photographs will last longer if displayed under better lighting conditions.
  12. I understand a $100 fee will incur if I need to change my photo shoot date more than twice.  
  13. To avoid disruption to the photographic coverage and to allow the Studio to fulfil its contracted duty; other photography by family/friends at this time is not permitted.
  14.  I understand I have engaged Mel Watt Photography specifically for the style Mel Watt Photography is recognised for as per website www.melwattphotography.com.au i.e. black and white.  All images will be adjusted for exposure, sharpness, brightness, contrast etc, however, creative expression and direction is at the absolute discretion of Mel Watt Photography. 
  15.  Booking fee of $150 is non refundable in the event of a cancellation.
  16. We take no responsibility for any prints created elsewhere from the digital files as all printers print differently, and there’s a huge difference in archival quality and tonal range.

 

THE STUDIO

  1. The price quoted for your order will be guaranteed for seven days otherwise the current price will be confirmed when the deposit on the order is paid. Any additional costs will be advised and confirmation required before proceeding.
  2. As the photographs made by the Studio are manufactured with the finest materials currently available, the Studio unconditionally guarantees them. If in your opinion any photograph made by the Studio has lost its original colour, the Studio will replace the photograph for fifty per cent of the current selling price. The original photograph must be returned and the reprinting charge paid in advance. This warranty will be valid for as long as the Studio has its possession the original files in a printable condition.
  3. The digital files remain the property of the Studio and will be kept on file a period of ten years, after which time the Studio may negotiate the release of the digital files.
  4. The Studio shall carry out this assignment with due and professional diligence. Elements beyond the Studio’s control include faulty material, equipment failure, loss of photos/digital files in transit between the Studio and professional laboratories employed by the Studio, loss of digital files during processing and developing either by the Studio or professional laboratories employed by the Studio, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent the Studio completing in whole or in part this assignment. In this case the Studio shall not be liable for its complete performance of the assignment. It is agreed that the liability of the Studio shall be limited to be a refund of any money paid under this agreement which shall be in full & final satisfaction of any damage or loss suffered.
